Presentation

The L&E Course aims to make the students familiar with the Regulation, analyzing its bias, tools, actors, regulatory assessment, and enforcement. The setting is the European Union (EU), while the scope is money. What is money? Can we consider bitcoins as money, from a regulatory standpoint? Some economists argue that money is not a “public good” and this means that there is no much room for binding rules or state initiative, but the Sovereign traditionally holds the power of minting coins and govern money purchasing power. Should we regulate money? And, in case, how? In the EU context, what’s the role of Member States, of EU, as well as the role of market operators and citizens’ associations?

Presentation

The undertakings are economic activities subject to competition rules as set out in the European Treaties and in the European secondary rules. They are applicable to all undertakings, with no exception. However, for some markets, such as the banking market, the national and European regulators try to get a trade-off between competition and stability.

After analysing the concept of undertaking as well as the primary and secondary competition rules at the EU level, the course focuses on some leading cases in the banking market, with a view of ascertaining whether banking business is dealt with as a “special” business, whether competition principles are applied in full, what the market bottlenecks are comparing the antitrust experience and the regulatory action. It is without saying that in the trade-off between competition and stability, the technological development performs a crucial role.
